Deeds are not complete - Should I inform the builders?

Hi all,

Here's my problem - a year and a half ago, bf and I put down a deposit for a flat in a new build in D 1. The deeds look like a phone book - 10-15 pieces of land were bought up for the build.

We actually didn't sign the contracts for another 6 months, because our solicitor discovered the builder's solicitors had not conveyed two of these pieces of land. (They had been paid for though, was an conveyancing oversight) We eventually signed, but only on the condition that they'd convey these pieces on completion.

Finally, our solicitor received the closing docs today, but discovered that they had conveyed the wrong pieces of land (land that was not disputed) and had already gone through the Registery of Deeds with the change. Our solicitor contacted the builder's solicitors immediately, but reckons it could take another month at the least for them to sort this mess out and to convey the missing sections.

My question is this - do you think it's worth me contacting the builders and mentioning the problem to them? Our solicitor reckons they're being kept in the dark about this problem until now...I know the builder's are as keen as we are to close. I'd like to have another party put pressure on the solicitors, because they have been very slow to get back to us in the past. (They had a year to sort out the conveyance issue) I'm not sure if this is alright for me to do though.

To make a long story short - should I say something, or just sit tight? I'd love to hear if any of you have knowledge of similar situations...thanks guys.

Of course you can inform the builders. They may also be aware of it but seeing as they would like to complete the sale, they may want to try and brazen it out! It wouldn't be uncommon for a developer to try and brazen something out. It's possible that they are not aware of this mistake but if they are not aware then it's in both your interests to inform them of this.

Thanks Crassus, I took your advice after the solicitor made more mistakes in the last two weeks, the builders were unaware of the problem (their solicitor later confessed to ours that this was indeed the case) Needless to say, the builders were onto her very quickly...

The problem was resolved in record time, and we finally got our keys yesterday. Thanks to everyone in AAM for your help over the last few months, and for the very handy search facility! Keep up the great work.
