Hi everyone! I've gone sale agreed on a property in Dublin a few months now (mortgage buyer) and I just realised there are some discrepancies on between the real boundaries and folio map.
I've searched across the whole forum on this topic but few points are still unclear so really appreciate your help.
The descrepancies locate at the back garden and involve 2 neighbours. A part of my physical garden is technically part of one neighbour's land on the folio map, and another part is supposed to be mine but currently behind the boundary wall of another neighbour. There are concrete block boundary walls built currently.
Both parts are fairly small corners, appx. 1sqm - 2sqm in total and I don't wish to make any changes.
The Vendor's Solicitor said they would provide a Statutory declaration to confirm that they have owned the property for 18 years and no agreements or disputes were made.
Would that be enough for bank to release fund to continue the sale?
Or would they require a deed of rectification to be logged or completed before moving forward?
Do I need to get confirmation from neighbours involved for the rectification request or can I exercise squatters right since it's been more than 12 years? If it involves the neighbours then do they just need to sign it, or would they have to involve their Solicitor and I'll have to cover that as well?
