years ago in college i made some stupid mistakes money wise and bank wise. As a result of this i have a CCJ against me. I now earn €80,000/year and am married, but am wondering if the CCJ will go against me for a mortgage as i was refused point blank for a credit card in my maiden name. I dont have any debts only a small overdraft with the UB which is cleared every month if used. I have in the past 4 years had two small loans which i got from UB as i had been pre approved for and had diligently paid them back. The ironic thing is that i am very low risk due to the bad experience i had, the stress i went through and also the salary i am now on. Will i ever get a mortgage and if so how? Do i tell them everything or wait for my past to bite me in the bum - and will it if i use my married name???????????
I'd appreciate any help.
 
Aren't CCJs specific to the UK? Are you based in Ireland and, if so, NI or the Republic? If it's the latter then I'm pretty sure that the , which most Irish lending insitutions check for credit histories of potential borrowers, does not include information such as UK CCJs. However a lender may ask for such information on application forms in which case you would be strictly obliged to provide it (or else run the risk of jeopardising your application, loan agreement or related insurance policies). Have you inquired (with UB or others) about getting a mortgage and, if so, what sort of response did you get?

No offence but on €80K p.a. how are you finding it necessary to use your overdraft!?
 
Firstly i'm based in ireland and the CCJ is a county court judgement which as far as i'm aware is definitely recorded by the Irish Credit Bureau. Either way i was refused a credit card based on whatever information the ICB have on me.
Secondly i haven't approached the UB for a mortgage as i have been terrified of being refused and dont want to mess up my record with them and lastly i would only use my overdraft (€500) where i have all bills paid, transferred my remaining funds as savings to the credit union or a second UB account and am awaiting expenses or i need to travel for work - i have myself fairly well budgetted so try not to leave excess money in the account - or i will spend it.

I didn't think that we had CCJs in the Republic of Ireland? After all we don't have County Courts [broken link removed]!

Well, if they were amenable to granting you unsecured personal loans in the past then perhaps they are happier with your credit situation now than you might think?

On this specific issue would it not be better to defer transferring money to savings to avoid using your overdraft since otherwise you are effectively borrowing (and incurring the cost of the termporary overdraft) while maintaining savings that could otherwise be used to avoid such charges? Unless you are saying that your expenses subsume the cost of the overdraft?
 
This is the information i was told by a Mortgage broker in the south.
The UB loans were upre approved, therefore the only basis the decision to approve me was based on my account usage.
And yes there are months where i should defer transferring money into savings accounts, i do need to plan ahead more.

CCJs are only an issue in the UK (including Northern Ireland). I can only assume that you were once based in the UK/NI and had a CCJ registered there and that this is still relevant to your credit record now that you are in the Republic? Either that or by CCJ you mean something else relevant to the Republic?

In relation to applying for a mortgage I can't really see what you have to lose by applying now since if you get it well and good and if not then at least you know where you stand. The only caveat might be that if the CCJ was c. five years ago then it might be worth waiting until the five years have definitely elapsed after which a record of such an event would disappear from your ICB records assuming that they log this in the first place.
 
When UB offer you a preapproved loan this is always subject to an ICB credit check, they will check this for every loan and if they were still happy to give you the loans then they should be happy enough with your credit rating. Also, when it comes to applying for a mortgage with them they will always do a check with the ICB and contact you if there is anything adverse on the report. Adverse credit does not automatically mean a decline - they will however need an adequate explanation for it. Have you contacted the ICB to obtain a copy of all information they have on you? Both their phone number and address are in the phone book and it only costs c€6 to get a full report.
