Credit card refund if do not receive a product bought via CC?

Hi,

a few months ago I bought a 100E gift voucher from a restaurant in Sandycove, paying via Credit Card.
Before the voucher was used, the restaurant closed down (since the owners went bankrupt).
My father went to the small claims court to try to claim the 100E back, but was unsuccessful.

My question is : since I paid by credit card, is there any way that I can claim the 100E back from the credit card company, since I didnt receive the product I bought?

Any advice appreciated.
 
It should be possible but by leaving it several months (why?) you may have eroded any entitlement to a refund. Best to get onto the credit card company pronto and enquire.
 
I imagine they'll argue that you received the voucher paid for, and that it's not 'their problem' if the restaurant folded before you used it... :(
 
Sorry - I thought that you hadn't even received the voucher. Seeing that you did then this is not a matter for the CC company even if you didn't get to avail of the voucher.
 
Have a read of this post, specifically the reference to the ODCA, they may be able to advise of what entitlements you have (if any) in this regard.

CC companies generally cover you in the case of goods that are never received or that are found to be faulty or sold fraudulently. The status of a gift voucher seems to be a grey area, as it appears that you may have a legitimate claim on the business that has not been honoured, even though you have actually received something.

The issue of CC companies being liable to consumers in the event of business failures/liquidations is discussed here and here. Have a read, and follow up with both the ODCA and the CC company. I would have thought you had no case until recently, but having thought about it, I think that you may. Yes I did receive the voucher. I've left it till now to contact the credit company, since it only entered my head yesterday, that they might be able to do anything about it!

I'll follow up on the advice, and let you know how I get on.
