Briefly, agreed to pay a deposit on goods that had to be manufactured. Payment was passed by phone to an Irish company in there Dublin showroom.

When my bill arrived it was was charged/billed by a Uk company (different name) and I was advised on querying that this was their company in the UK. I now believe the UK company is a supplier only to the Irish company.

The goods were destroyed on two occassions once by the manufacturer and second by the Irish company in handling of goods and cancelled on the basis that they were unable to fullfill the order and due to undue hardship that this has led me cancelling the order and placing it with another company.

Initially we were offered a refund by the Irish company but due to our complaint to the Irish company we have been told to bring them to the small claims court to get our money back. Who is legally responsible.

We feel misled by the Irish company who appear to have used my credit card to appropriate goods from a 3rd party.

I will of course proceed with a charge back through my credit card but if this becomes legal who do I take action against.
