Crash Damage

Hi there,
I recently decided to trade up my current 01 car (toyota) for something newer. Went to a local main dealer to test drive the desired car and find out what I might get for my own. When the sales guy inspected my car to see what it might be worth for a trade in, he said that it appeared to have had a panel and bumper resprayed, indicating crash damage - I was pretty shocked as I had bought the car almost new in 2002 (9k miles on the clock and under a year old) from a reputable main dealer.

So my questions are:
1. Is a garage obliged to inform me if they are selling a car that has had a crash of any type? How can I confirm either way that there was previous damage / respray of part of the car?
2. Could the sales man be pulling a fast one to convince me to offload my car for a low trade in value?
 
Thats the oldest trick in the book!!! Walk away there's no shortage of cars out there believe me.
