Copyright Law and uploading YouTube videos

Can anyone clarify the "Law" in relation to copyright if........I want to upload a funny home made video on YouTube BUT if I want to use a piece of music or popular song as a background song.

Can I do that or do I need prior permission from the copyright holder of that music?

Yeah, I think if you use an artists material without their prior written consent, then you are in breach of copyright laws... There really arn't a whole lot of people who abide by this law though. Just look at youtube, most home movies have music attached. If they were in trouble over it..the movies would have been removed.
