Hello.

I have a query about an issue in my contract and am wondering if anyone could advise me.

Several years ago, I was givenb a hefty pay rise - on the condition that I signed a contract with a longer than usual notice period. It was normally one month, but mine states nine months.

In the interim, we have had two pay cuts. One was last year and the other was last month.

The combined effect of these two pay cuts was to, effectively, wipe out my previous pay rise.

My query is this: what does that mean for my notice period? Can I argue that the contract has been varied?

When they varied your contract (recent pay cuts)was their any consultation and did you sign anything?

If the answer is no and you are looking to leave you have grounds to quit and leave immediately as its constructive dismissal as its a fundamental breach of your contract and mutual trust etc...

If you are looking to take up another job that is worth considering...if you are just asking for sake of asking and the answer is No to the above I wouild think you could still walk out of your choosing but they may come after you ......the EAT would likely look at when the conditions changed and when you walked

If you signed an amended contract after the pay cuts you would likely be bound to your notice period
 
Hi, thabnks for that.

I signed a permission note after the first pay cut. The second one has not been implemented yet, so we have not been asked to consent to that.

I am thinking of writing to them to the effect that i will not consent to the second pay cut until my period of notice is reduced.
 
I would probably have that conversation with them and see what happens...because you consented initially I think you should get legal advice if you want to get out of the clause
