My huband is currently ( just about ) employed in the construction industry.

I would expect he will be made redundant in the coming months.

Up to about a month ago it was common that some of the employees would put materials needed on the job through personal credit card and then get re-imbursed by the company.

However the last cheque he received for approx €2.5K bounced and his employer has said he will pay this to my husband when he receives a lump sum of cash he is due. Apparently this has been received and he is still refusing to refund the money due to my husband.

It is very obvious that my husband's employer is insolvent at this stage as we have discovered he owes money to the CIF re pension.

There is also storys going around that he is involved in new other projects outside construction industry.

However if my husband leaves he will be walking away from stat redundancy amount due to him ( not very much I know )

My question is, if he is made redundant where does he come in the list of preferential creditors for payment of the amount due to him

Do we have any other options to recover this money without compromising the stat redundancy due to him ?

Any advice appreciated

Thanks

T

Re: Employer owes husband expenses

Sorry you are dealing...
Perhaps the small claims court.

I certainly wouldn't leave over 2.5k at this point.
Just stick it out til the bitter end.

Re: Employer owes husband expenses

Has he got any documentation to confirm that the amount is owed?

No- in the construction industry you are not likely to get a contract of employment never mind a document to confirm outstanding expenses ......
