Common areas not handed back by developer

I am looking at buying a house and the common areas (Green areas + Roads) have not been handed back to the management company by the developer. The thing is the last house was sold on the development in early 2001. This is kind of ringing alarm bells for me, my solicitor is in the process of finding out why it hasnt been handed back. What do people think of this?

Also there is a management fee of €1,000 for the estate (including refuse), as the roads are private and there are gates on the development. It seems a bit high for a house.
 
The development is fully finished and the management company take very good care of it. I was just a bit worried about problems with the common areas not being handed over, as the estate is gated it will never be handed over to the local authority (due to right of ways).
