Claiming tax relief for partner's college fees

I'm sorry if something similar is here already - I couldn't find it.

My partner is being made redundant at the end of April and intends going back into full time education in September for a year. Also we're getting married in September.

She already has a post-grad and isn't entitled to anything in terms of grants, apparently, so if I pay her college fees (about €7,000), can I claim tax relief? Can I claim at the higher rate? And does it make a difference if we're married or not at the time I pay?

Also (side question), will she have to wait til next January to claim back taxes paid to date this year, assuming she will have no more income this year? Or will they take the fact we're married into account, add up both our gross figures for the year, and give her nothing?

The Revenue leaflet on tuition fees is here and there is a cap of €5,000 pa at atandard rate of tax only. Once you pay you get the relief, married or not that no longer matters.

Year of marraige you are still treated as single during the year. You can apply for a YOM review after the year end. If she has no income from April she can apply for tax back on form P50.
