Claiming Tax rebate after more than 4 years?

There was a thread recently on tax rebate after ML and I found out that my employer never 'balanced' my tax for either of my 2 maternity leaves. I just presumed they had because the social welfare part of my maternity pay was automatically signed over to them and I was paid as normal.

My fault for not looking into it closer at the time but now I've gone about doing it and was told that I can only do it for second ML, not for the 2002/2003 leave because the 4 year window is up.

* Is there anywhere I can go to appeal this?
* Is there anybody I can write a letter to etc. or am I banging my head off a brick wall even trying to go about it?
* Did anybody here ever claim after >4 yrs?
* Any advice?

As far as I can make out it'd be worth nearly 5K to me so def. worth the hassle if there was ever a glimmer of hope.

:mad: I'm really annoyed about it tbh. I've no doubt that they can chase me for money for >4yrs so don't know why it's not a 2 way street?

Because that's the law. You can ask Revenue nicely but I don't know of any successful appeals.
 
Just because its the law does not make it right. As far as I am concerned the state has robbed the OP the same as a pickpocket or a burglar. There is no moral justification for what they are doing. I have made a number of appeals on behalf of clients in this matter and have had no success. I have made representations on the unjustness of this specific case and have received a reply from the Minister of Finance that basically says 'bog off'. The legality of this law needs to be questioned but because of the cost no one specific tax payer is going to challenge it.

It is the taxpayers responsibility to claim their entitlements.

It is not reasonable to expect the revenue to know the individual circumstances of each taxpayer if they are not informed.

In my opinion 4 years is a reeasonable period for anyone to get their affairs in order.

I do agree it is unfair that the revenue can go back 6 years. This should be restricted to 4 as well.
 
They went back 15 years with me, and could not give me full details, so they had to drop it. It is certainly an unjust system. As I have said before in posts, not all people understand accounting, manual workers etc. and cannot keep things in order, when they discover at a later date they could have made a claim.
I would like to know legally how long a bill could be outstanding if person did not know they owed money.
