Hi

What happens in a case where you want to take a civil case against someone but you do not know their address.....can you send the summons via their solicitor ?

Well - you can ask the solicitor if they have authority to accept service? But if they don't then you have to find out where the person lives and try and serve them.

If there is a deliberate attempt to evade service you can apply to the Court for an order for substituted service - at a place other than where the defendant resides.

If you don't know the address of the person you want to sue you need to ask yourself why? Are they deliberately avoiding you and perhaps others as well?

Thanks for that.

Is there a time limit on taking a civil case ?

I think its 6 months for a criminal case ...is it the same for a civil case ?

Yes there are different time limits depending on the type of case.
