Circuit Court re Mgt Comps and PRTB

Hi, I spotted an article in the Irish Examiner a few weeks back and kept it - of course forgot to keep date of paper but anyway, quoted as follows

"JUDGES RULING ON TENANCIES, The Circuit Court has ruled that owners of apartments run by a management company are classed as tenants and therefore not excluded from the provisions of the Residential Tenancies Act 2004. A judge yesterday ruled these tenants may now have complaints against these companies regulated by the Private Residential Tenancies Board and not the Court"

I'm certainly not a legal eagle but whats anyone's opinion on this? Personally having non stop issues with my mgt company, they are so lazy, paying them since 2007, never seen accounts, no AGM, work not carried out despite all the promises etc etc...so frustrating. Wondering if anyone has any experience of contacting the PRTB yet on this?
 
Don't get two excited. Either the PRTB's remit will have to be expanded to cover this or the loophole will be closed and this judgement reversed. My money's on the latter and very soon!
 
Good luck dealing with the PRTB. They can't even cope their current workload.

If I called them useless I would be making an understatement.

My own personal case with them was a disaster. They were absolutely useless and had made up their minds at an "adjudicator" meeting before mine happened. I was steamrolled into agreeing a certain stance that was unreasonable. I ended up having to move house to get satisfaction.

I have never ever ever met anybody (and I have talked to several solicitors on this) who think that the PRTB is remotely competent. If you intend using them , bring legal advice and expect alot of mud to be thrown.

I don't understand this, how did they steamroll you. Could you give us an outline of what happened?

OP I just laugh to think anyone believe the PRTB will force management companies to do anything. In any case aren't managment companies owned/operated/voted on by the owners? Maybe I don't understand this.
