Chimney height guidelines

Can someone perhaps advise if there are planning rules in respect of flue/chimney heights from solid fuel stoves ?

A neighbour has one freestanding in their kitchen and the flue (a stainless steel type one similar to what is installed on the oil burner) extends through the kitchen wall and just about a foot above the gutters on a dormer bungalow. Everytime they light it the fumes are coming in through the vents and fan outlets at the side and back of our house, also a dormer. Naturally I should have queried this when it first went in but I honestly thought it was temporary. So since bringing a new baby home, I can't take the worry of thinking what it is doing to those tiny lungs.

Anyway, just wondering if I have some sort of building regulations on my side before I figure out how best to approach this. Dreading ruining what is otherwise a very good relationship with our neighbours.

Anything in the http://www.environ.ie (Department of Environment) building regulations/standards on this? The regulations are on their website.
