Hi, am living in uk since Oct 2012 and am claiming child benefit in Ireland as I was living there all my life. my partner is working for an Irish company and getting paid Euros into an Irish account so should I still be claiming in Ireland or in the uk? We will be over here for a year. Also if I should of been claiming over here and not in Ireland will I have to repay any money even though I have only been claiming one payment of child benefit? I thought if partner was paying prsi etc in Ireland we would claim benefit in Ireland
 
The operational guidelines for Child Benefit state that:

Residence of the Child
The child must be ordinarily resident in the State. This requirement is deemed to be satisfied in cases of:
  • members of the Irish Defence Forces or the Irish Civil Service serving abroad,
  • volunteer development workers, or
  • persons temporarily employed abroad by an Irish employer and paying Irish social insurance contributions.
You may satisfy the third condition (persons temporarily employed abroad....) however I would check with Child Benefit Section in Letterkenny as they will pursue an overpayment if one exists.
