Hi all, looking for advice re a certificate of compliance. Four months ago I had sale agreed on a property. Last week I signed the contacts to purchase the property and since then my solicitor has raised an issue with the planning permission 1981. She says the planning instrument refers to an earlier planning permission in 1974. She is holding off on sending the contracts over to the vender for the time being and wants me to employ a surveyor to investigate this.

I have a few issues with this...
firstly, should the onus be me on the purchaser to prove the property is in compliance with the planning permission. Should the vendors not pay of the certificate of compliance.
Secondly, Should my solicitor have noticed this sooner before I signed the contract.
Thirdly, given that the property is over 30 years old, is this really an issue worth delaying the sale. I have given notice on my rented accommodation and was expecting to move in soon asap.

1. This vendor should provide and pay for certificate of completion.

2. Yes,your solicitor should have noticed this prior to signing.

3.If you don't get good title you will have a difficulty selling in the future.
