Our son applied for car loan and mortgage recently. He was refused for both as a ‘CCR’ bad record .

when he checked things out - he found a €400 credit card balance written off by a ‘former’ bank. This ‘former’ bank closed all his student accounts when he highlighted bank administration errors on his accounts and sought a data protection act copy of records.

the bank failed to produce the records held and formal investigations by the Financial Ombudsman and Data Protection Commissioner are ongoing for past 3 years.

he sent in an ‘explanatory note ‘ to CCR.

is this sufficient ?

Did he owe the €400 or not?

Failure to pay a balance is the best predictor of mortgage performance.

I am sure that he would be able to find many "administration errors" by his mortgage lender as well. That would not be a reason for non-payment.

he doesn’t know what he owed at the end. He didn’t refuse to pay anything from what I know.

The bank refused to provide any account details of his credit card when requested. He presumed that this was a basic banking requirement.

The DPC and FSPO are investigating ✅

appears bank can submit anything to CCR and it gets recorded? They don’t have to admit errors, say amount in dispute or active investigations , etc ?

The bank refused to provide any account details of his credit card when requested.

So they did not send your son a statement?
You complained to the bank and they rejected it and still did not provide a statement.
The good news is that your son will get a very substantial award from the Ombudsman.

He should apply to a few banks for a mortgage and get refused a few times.
Maybe even go through a broker.

Sorry it’s not as basic as a statement. Think he’s up to 1600 euro in compensation they made so far for errors that they admitted to. Not sure how fspo works but seems to be slow
