Hi all

I was wondering if someone could assist me on the below.

A married couple. The husband had some acres of family land that he rented out. The land was co owned with his brother.

The husband passed away in 2023 and all his estate went to.his spouse. No tax implications therefore.as spouse to spouse.

In 2024 his wife and brother decided to sell.the acres of land ( they both were not farmers)

For the cgt for the spouse.

Would this be just calculated on.the date from.2023 to 2024 , as this was the date the land was changed into her name?

The land was never in her name prior to 2023.

I wiudl appreciate feedback on this

Thanks so much

No. If you inherit land (or any other asset) from your spouse, and subsequently dispose of the land, you are treated for CGT purposes as if you had acquired the land when your spouse acquired it, and at the value at which your spouse would have been treated as acquiring it.
