Can you sue older brothers, who were the executors of a will many years after the probate when you relaise that they have not executed in line with our fathers wishes in the Will but instead they have just ensured they got what they were willed and more from the estate. I have checked with the www.landdirect.ie and the Registry of Deeds and Land that was supposed to have been transferred into the younger siblings , myself and my younger brother and sister, has not been done so. Neither of the executors have ever given the younger members of the family any documentation subsequent to our fathers death. My mother was not provided for as per the instructions in the will and one of the executors made our 63 years old (at the time) mother sign over money only 3 months after our fathers death to pay off their own failed business debts. Any advice welcome.

If many years have passed you are likely out of time. Have you seen a copy of your fathers will.

You have choices, seek proper legal advise to see where you stand or else forget about it for the sake of family cohesion.

How many years since probate was granted? It sounds as if it is many many years ago. So unless you have some unusual circumstances I can’t see how a complaint now will get anywhere. Why did you not take action at the time?

Your complaint is that the executor did not execute the will correctly? So land that was willed to you was not transferred into your name? I would suggest discussing this with a solicitor who will best advise you.

I think Bronte has given you very good advice so consider this before you follow any advice from your solicitor.
