Cancelling the Contract of Intention to Purchase

Hello All,
I signed ricently the Contract of Intention to Purchase property in Morocco during the EXPO 2008 in RDS. I was told that the complition of the building is 01.10.2008, being under heavy pressure from the staff and trust them I paid deposit, signed it and came out home. When I read it carefully at home I found that the real day of the comlition is 01.12.2009.
Next day I came in the office, they agreed with the wrong date, but trying to involve me to buy and singned another propertes in other countries saying that it is the policy of the company. But I just want to cancel the contract and get my deposit back. Could you advise me please, should I get help from solisitor and secondly do I have any chance to get deposit back ?

I'm afraid a contract is a contract.
And don't sign anything, unless you are sure about the facts, figures & details of the deal.

I paid a deposit of €4,000 on a property in Portugal at one of those
Expos, mad, stupid some might think, but anyway I did it, and then I got
a gut feeling that I made a mistake. I was told that the deposit was non-refundable but I asked my solicitor to try anyway to get it back, I was very surprised to
get €3,250 back so definitely ask them to try.
- Incidently my gut feeling was right the firm of soilitors I was using Michael Lynn & Co !!!!!!!!!
 
i think you could get your money back if you put a bit of pressure on, was the deposit paid by credit card ?
 
I think you need to act fast and talk to a solicitor for advice. I'd be surprised if you couldn't get your money(less admin fees etc.) if you claim you felt you were pressurised into signing the contract. I think an adjucator would consider important how quickly after the contract was signed, you started to request a refund.

Parties to a contract are not suppose to be acting under undue stress/pressure

Fortunately, I paid in cash just € 700 did not have credit card on me, so going to get solisitors' help, I can not belive how can we be mad sometimes
 
just as a matter of interest was there many other exhibitors at the exhibition or only one ?
 
I was going to attend the seminars which are I find were very helpful, but being walking throug the expo was stoped by lovely girl and that was my mistake, as far as I remember at the first 2 days there were not many exebitiors, but at the last third one day they were a lot
 
700€ (plus the rest of the misery) for a tête à tête with a lovely girl.
Hope she was worth it :cool:

Michael is out of the country at the moment, attending some sporting events at the likes. You could contact interpol and ask them to forward a message to him, but their credbility is not so good, so high risk strategy...

Im not a big fan of solicitors in general. You'll pay him more then what you'll get back off the company so its pointless

if your smart and mention the media etc the company will most likely give you your money back.

But really you have only yourself to blame you couldnt make a more elementary mistake then signing something without reading, and I think its a cheap lesson at 700euro
 
Nicky - I just wonder how legal the contract you signed really is. The vendors know that you can't / shuldn't exchange contracts unless all the title papers are gone through. Is what you signed a polite scam to make you think that you are roped in. Me thinks that their ethics stink. Call them and make some excuse. Find a Solicitor if you getting nowhere. BTW Michael Lynn is the gangster solicitor that has run off with €80 million of Bank's money and a heap of client funds, in case you didn't know. Let us know how you get on.

You are right, they did not say that the deposit is not refundable, they try to turn me to others properties, saying that is the company's polisy, but I simple do not want to, after given me different date of complition, also I had a look using google map at the buildings place, there is nothing at all
 
Is this company Irish registered ? If so surely the Consumer Affairs Association should intervene.
