Cancelling Gym contract. hygiene issues

hi people , am a member of a gym, i have highlighted issues, of a hygiene related issue, dirty floors, dirt in pool, etc etc..

i highlighted the issue to the gym in question , where they said they would sort it out in about a week,,


over two weeks since them promising to improve cleaning, nothing has changed.. i received a text from them this morning asking me "to upgrade your membership for more benefits"...

can i get out of my contract, by the fact that they are not living up to the terms of the contract, ie by providing a clean gym.. ie can i say that they are in breach of contract?? and then cancel my contract...

i have kept copies of the emails i sent and their replies and times dates when sent...

I could be totally wrong but is there a chance you are maybe being a bit over sensitive?

I've noticed that in otherwise very clean and well run gyms/pools, floors can get a bit dirty very quickly - it's a difficult thing to keep completely on top of.

in all honesty, is
1. used plasters floating in the pool
2. chewing gum stuck to tile in pool area
3. stained shower doors , with , some sort of bodily fluid running down it..
4. dirt on the ground.....

i dont think i am being over sensitive..
