for example if a company has 100 shares issued can 3 people own 33.33 shares each or do you need to issue 2 new shares and have 34 each?

How is it arising?

I was involved in a transaction where two people were acquiring a company where there were three shares.

Before the transaction took place, the three shares were split in two leaving 6 shares. (This transaction gave rise to no tax consequences.)

They then bought 3 shares equally.

In the general case, yes.
But, in the case of "direct" ownership such as you describe, the sort of stock split approach described by @Brendan Burgess allowing each shareholder to own a round number of shares might be easier to manage?

I don't think this is true in an Irish context.

its an OMC for a developement, the developer has transferred his 100 shares equally to 2 directors. There are 22 units and the shares should be owned equally by each homeowner.
