Can i claim 08 tax that was paid in 09?

Hi folks,

This is a bit confusing but i hope you can follow!

I started work in November last year after graduating from college. I was being underpaid (due to payroll error) until January this year.

I since got all pay backdated but was taxed approx 1.2k (2008 backdated pay + correct January wages).

My question is can i claim back the tax paid on my 2008 pay and how do i know how much tax was for 2008 and how much tax was for 2009 as it all came in the one paypacket?

Let me get this right... It sounds like you were given less gross pay in 2008 than you were due and this was rectified in 2009. So, you've paid tax on that underpaid/reimbursed amount in 2009 and you feel that had it been paid in 2008, you wouldn't have paid tax on it.

If I have this right then, unfortunately, to my knowledge there is nothing you can do. As an employee your salary is taxed at point of payment, not when earned. You could ask your employer to amend your 2008 payroll to reflect the amended amount. They could then amend their P35 and pay you the full amount (less, perhaps a small bit of PRSI).

If they don't do this for you then, in my opinion, they're either being lazy or just downright obtuse....
 
Thats correct billythefish you have summarised the situation better than i did! So i guess there is no point in going to my local tax office to get this sorted?
 
No, the tax office won't do anything. It's all down to your employer so it depends on how much they're willing to help you...
 
We do this here all the time. We show how much earnings relate to other tax years. We give it to the employee who takes it to the tax office - its usually when for large amounts of monies though.

Hi Becky - Do you work somewere that does this? How do i get in contact?? Over 1000 euro is a large amount for me!
 
I raised the query on the other thread and received a statement from my employer stating how much of earnings in 2008 referred to previous years. The tax office have accepted the letters (but no sign of refund yet...). Will let you know when the cheque arrives.

Hanks09 - I received a cheque back from revenue for the tax that I had overpaid.
My claim was for 2007 therefore I was advised to wait until I received my P60 for 2008 and then I sent in a letter from my employer stating how much earnings in 2008 related to 2007 and previous years. I also sent in copies of my P60s.
I received P21 balancing statements for the years in question showing the amount underpaid/overpaid in each year.
