Can an employer refuse to apply SCSB on redundancy payment?

Hi,

I'm in the process of negotiating a redundancy lump-sum with my employer.

SCSB can significantly increase the tax-free amount for me. If my employer resists applying SCSB to the ex-gratia amount (for whatever reason), do I have a right to insist that it is applied?
