Hi,

My OH as issued a letter by his employers today stating that he ( or any member of staff) by law, are liable to be relocated anywhere the company chooses. If they dont move they can lose their jobs. They are doing alot of work in the UK at the moment and I think they are gearing up to move some staff over. Can they do this? It is mentioned in his contract that he may have to work Nationally and Internationally sometimes?

I've tried looking for information on this but cant find anything.

Any help would be appreciated.

Sounds to me like he can in this instance as it is stated in your OH's contract. The employer is probably trying to sound out the staff by issuing the letter. They state by law as they have it included in the contract. They may also be looking at redundancies so checking at who would move therefore knowing to hold on to them.

The employer will also need to consider whether the relocation may result in an entitlement to a redundancy payment for employees. There are no specific rules which determine when a relocation will result in a redundancy entitlement for an employee and the facts of each case would need to be considered. A relocation of in excess of 20 miles may be perceived as significant and is likely to be perceived by the employee as a change in the terms and conditions of his or her employment. Such a change in an employee’s terms and conditions may entitle the employee to argue that he or she has in effect been made redundant and therefore is entitled to a redundancy payment.

Does the clause in the contract refer to permanent or temporary changes in location?
