Buying out partner, does stamp duty need to be paid?

I bought the property with my partner in 2005 for EUR 340,000 and then in 2007 split from my partner so I bought him out. When we initially bought the property we did not pay stamp duty as it was a brand new house.

When I bought my partner out I was advised by my solicitor that I had to pay stamp duty. I always thought this wasn't correct and since then my solicitor was found to be corrupt and removed from the list of solicitors. I just want to find out if this stamp duty needed to be paid. For info I was not a first time buyer when I bought this property as previously owned an apartment.

It seems correct to me. Think of it as a separate transaction.

You were not a first-time buyer
You were not buying a new home

So why should it have been exempt from stamp duty?
