Buying a House Not Taken In Charge

I am in the process of purchasing a house in Cavan. The estate is not taken in charge nor is there a managment compnay in place. There is however a residents association which is entirely voluntary. The builder is in liquidation but the estate is absolutely fininshed and 99% of the homes are sold and occupied.

My solicitor has raised the question that in the absence of anyone taking responsibilty for the Roads Services etc., that I may encounter problems
tryinging to sell the property in the future as a lending institution may refuse to finance the house.

On the other hand it seems that many houses I have looked at are also not Taken in Charge and a large number have builders who are bust yet
you still see properties being sold in these.

Any advice would be appreciated.
 
My understanding is that Cavan County Council applied conditions against new estates in the county that require a management company exists. Without one, the place is not in accordance with planning laws. That management company (in Cavan) is responsible for the upkeep of the common areas (cutting grass) and public liability insurance. The council should then take in charge of the estate when it is finished, and look after the roads, sewage, lighting etc.

The problem is, Cavan council don't seem to be doing that due to a lack of funds.

Since I don't know how old your estate is etc, you should try to get confirmation about the council's requirements for the estate, and when they will take charge. They could be in the process of taking it over and no management company is required. Alternatively, they may have no intention to take it over due to a lack of funds, and will also need a management company. That would leave you and the other residents a bit stuck. When a water pipe cracks under the road or a sewage block occurs, the ONLY people who will be able to do anything about it are the residents. And people who aren't directly affected by a problem won't pay, and thats where it gets nasty.

My own personal advice is to steer clear. If the opportunity to buy another house ever arises again, I will not be buying in a management company estate. I have made a few posts in the Management Companies section around my experiences, you can see the grief it causes!
