Is there anything that can be done in the instance where a builder uses members of his family to buy sites, apply for planning permission build house only to sell months later....a previous thread indicated that if the council were aware of this, planning would not be forth coming ...ie there was no/never an intention to even move into the house...it is purely a business driven application...

Fair play to 'em, that's what I say.

Unless there was any condition in the planning that they actually occupy the property, I'm not sure what can be done retrospectively.

If a couple apply for planning for once off housing they have to show they are from the area, have family, intend to stay add to the community etc.The Builder can only get around this by using family members applications...once done he sells but I thought the council could claw back some monies as he has violated the planning conditions....

Similar to what is being discussed in this thread?

The Council can't be everywhere. If the builder is doing something illegal, do you not think OP has a civic right and even duty to see that the law of the land (and other such high minded things) are upheld?

I didn't realise planning permission involved the vetting of potential occupants.

In certain areas where planning is sensitive (for environmental reasons etc.) it's up to the council to limit urbanisation while still accomodating locals who want to build on their own land - but if an abuse is taking place - i.e. permissions obtained under false pretences then I think the OP is justified in their concern. And if it's happening beside them, then it is their business.

It's because of my involvement in the local community that this issue affects me.However when I see the same member of a family who are developers apply and receive FPP for 5 different houses within a 2.5 year period it bothers me...particularly when FTB can't seem to get FP permission on the same land...doesn't lead me to think that the Co.Co.are discharging their duties properly, hence I asked the question....

Go into the planning office & look up the planning files for all these different houses & see on what basis they were applied for/ if there was any occupancy condition etc.
Mayb the planning dept are trying to encourage development in the particular area?

The original question didn't really make a whole lot of sense in the first instance. A large proportion of planning permission applications are in the words of the OP "purely business driven". Not many builders or developers build houses for the good of their health - they do so to make a profit. There is no law against this. If there was, no housing estate would ever be built in the country.

Pennypincher, do you live near me? I see the same thing, Conditions are put on planning that immediate family have to live in said house for five years, but hey presto, sold, and someone else living there. Council dont want to know. But I am not going to say which council, if anyone wants to know they can PM me.
