Hi all,

I just started a job as a seasonal worker, contract from today to end of Oct. The time worked per week is 39 hours, daily hours 9.45am to 6pm. We get two 15 min breaks and half hour for lunch. First question, am I entitled to 1 hour lunch?

Secondly, contract states that we get 22 days annual leave pro rata, working out about 12 days entitlement, but was informed today that we are not allowed take it, and that we get the money istead. Is this lawful. Any help greatly appreciated.

Half an hour is the legal minimum lunch break so they're within their rights on that one and the answer is no you're not entitled to a one hour lunch.

I've never heard of someone not being allowed take annual leave but if you have a 6 month contract it may be presumed you get a break in October. If your contract says you get the leave and you were verbally informed of the restriction after you signed it, then you may have a case to argue.

Have they offered the 12 days leave at the end of the contract i.e the first 2+ weeks in November
