Boundary Walls

Hi there,

Hopefully someone can tell me my rights with regard to my boundary wall. A house is being planned to be built next door and if they get the go ahead what can I do about my boundary wall with regard to workers standing on it or placing scaffolding on it. The reason I ask this is (really and truly), I objected to the building next door and the people involved would think nothing of ''falling'' off my wall into my garden and then suing me. They are the type of people who throw themselves into holes to claim 'compo'. Can I tell them not to stand on the wall and not to place scaffolding there..

The boundary wall - if entirely on your land will be yours. If any of it is on the neighbours then it is joint owned. Regardless of that if it is maintained by both of you then I believe both have joint rights over it (like with a hedge).

At a guess I'd say the neighbours builders are subject you your neighbours domestic insurance as they are employed by them and do not have permission to be on your wall.
 
Many thanks for your reply. It is a jointly owned boundary wall. My worry is that these people are 'dodgy' characters and there is really bad feeling towards me because of the planning objection....

if its joint owned then they have a responsibility to maintain their side.. ....as you do with yours...

if they 'fall' off it into your garden.. go out with a hurl and beat the head off them... claim that you though they were burglars and you were protecting your property.
 
whoever is building should have liability insurance or the builders should have it before they commence. Can't see if they fell into your garden, how you would be liable?

If that was the case people would be throwing themselves on other peoples drives for compo
