Bought Voucher but cannot use

Our family bought a voucher for a family member for Christmas which was to give him a driving session at a well known Car Race Track. This was purchased by phone using a visa card after getting the number from a pre Christmas advertisement on the Radio, a number of paper adverts in newpapers also.

All seemed well enough until he went to book it during the week when the person taking the booking asked what was his height and then advised him that he could not use the facilities as he was above the allowable height restrictions and was then advised to look at the Terms & Conditions of the voucher and yes indeed it does say that before booking a session the above average person should check it's suitability. When he enquired as to any recourse the assistant said they couldn't advise but all that they could say was the vouchers were not refundable and really was insistant on that point.

Now, fair enough we should have possibly read the very small print but instead we just popped it into the Christmas Card and gave it to him on Christmas Day and I'm sure like everyone else who gets gift vouchers at Christmas he didn't think to sit to read the Terms & Conditions.

Does anyone know where we would stand on being entitled to a refund (couple of hundred euro), we bought it after getting the number off of the radio, it did not on any occasion that we heard it state anything about height restrictions or any reference to terms and conditions apply. It is not that he does not want to use it, it is that they will now allow him to use it, surely it would appear that we are entitled to a refund so we are not out of pocket and him without a Christmas gift, any comments? Oh and no the height was never brought up when the booking was made on the phone nor did it even occur that it would be an issue. Thanks
 
Contact the NCA at www.consumerconnect.ie and ask them what your statutory rights are. Unfortunately in general there are few statutory rights with vouchers. It is quite possible that the voucher is not transferrable and they are not obliged to give a refund.
