I bought a tractor from someone (a private individual) in the Buy and Sell Magazine. Turns out to be defective and I spent €2,500 in getting it repaired. I know in order to come under the Sale of Goods Act 1980 the Vendor should be acting in the course of business so I have no come back here. Does anybody know what legislation would apply here. It's a bit too late for Caveat Emptor! Thanks.

Why is defective written after this? Thanks for the website but unfortunatley it's something I should have read prior to purchase! Can I argue misrepresentation? I have the newspaper clipping stating that the Tractor was in perfect condition.

Of course you can argue, but where?

You are faced with taking vendor to a court of some kind and substantiating the "misrepresentation" claim. Who's to say you didn't break it after it was bought?
 
Unless the vendor deliberately withheld information from you regarding a fault you have no comeback whatsoever. It was up to you to establish the condition before you bought it.

You'd have to go to court and sue for damages. I don't see you getting anywhere with it TBH. I'd say you've ruled out even the possibility of it now because you've repaired it in any case.

Because your original title " Buying goods advertised in Buy + Sell Magazine" wasexpanded to "Bought a tractor from private individual: advertised in Buy&Sell Mag. Defective". AAM posting guidelines ask that titles be meaningfull and reflect the content of the question.
