Boiler flue regulations

Our neighbour has a oil tank and the boiler connected to it next to my outside wall, the boiler then has a large flue which is attached to my house wall, he is saying this is legal as that part if the wall is in his property. the flue is very near my bedroom window am nervous it’s not safe can I do anything here, is this a local council question ?

Flue positioning is dealt with in Part J of the building regs. It doesn't look like that flue is high enough over the intersection with the roof.
