Beneficiary of a will with no probate

Mum recently passed away and left a will for my brother and I to be the beneficiary. My niece was made executor, but the Will didn’t go to probate. My brother and I have asked my niece for a copy of the Will and of mums accounts, but she is refusing. Can she do that? How do we know we are getting my mums wishes if she won’t show us mums estate? Are we right in asking to see the accounts?

What's the storyline? Why won't she show you the will and details of what is in the estate?

When did your mother die?

What assets are in the estate? Is there a house? Post Office savings? Bank accounts?

How do you know you're beneficiaries if you don't have a copy of the will?

If there is an impasse- you probably need to get a solicitor involved.

Very sorry for your loss.

The executor is not obliged to show you the will. Once probate is completed the will is a public document and you can get a copy of it.

Bear in mind two things

Your mother appointed her grand-daughter as executor so evidently had full confidence in her.

The executor has at least a year to get a probate application done.
