Barbed wire and the new "defense of the dwelling bill".

I had barbed wire on my back wall when I bought my house and left it there for about 5 years before removing it to do some refurbishments of the back yard.

Since then there has been a break in due to an intruder jumping the wall.

I'm obviously looking at reinstalling some kind of protection.

I've read mixed messages about the legality of using barbed wire but am wondering if the new home Defense Bill protects me from being sued by a someone hurting themselves while attempting to scale the wall.
 
I was talking to someone in the trade last week about razor wire, I was told that once it was above 2.2 meters, your ok.
As to the credability of this, I dont know.
 
Only thing is a fence above 2m would require planning permission.

If I had barbed wire up there previously would I still need planning permission?
