balancing statement for a couple

This is the situation my sister finds herself in. She had a lot of medical expenses last year and filled out her Med 1 form in january. She is just about into the 41% tax band so she presumed she would get 41% of her expenses back. But the way the balancing statement is, she is only getting 41% of the amount she is paying in the higher bracket. The rest is at 20%. The really sickner is that she was married in 2007 and never bothered to change her tax to being a married couple. I have worked out that due to her husband earning more than her, that if they were taxed as a couple she would have got 741% of the full amount. My question is, is it possible to ask the revenue to change both their taxes to a married couple from the year they were married and get another balancing statement which would give her the difference in what she thought she'd get and the actual amount she got back? Sorry for the long winded way i asked the question but i suppose you need all the info before you can comment. Thank you in advance
 
Your sister should certainly inform the Revenue Commissioners that she got married in 2007. In general, there are no tax disadvantages for 2 income married couples when compared to individuals/ single income couples.
The Revenue Commissioners will issue amended Balancing statements for 2007 and 2008 using the revised SRCOP's and tax credits. She should ensure that she has all documentation re medical expenses to give them when requesting the update to their status.

I know that it will make no difference to their tax paid but the fact that between the 2 of them they will be paying more in the higher rate means that she will get 41% on her full expenses. And yes she has alll receipts kept safe and sound if the revenue decide to investigate in the future!!! Is the required form available on the revenue website?
 
As I recall, when I married I brought a copy of the marriage certificate and a letter stating that I had married on XXX date to my local tax office. The necessary details / processing were done there.
There may be a form but I don't know for sure.
