Auctioneer didn't collect booking fee first

If an auctioneer says in his contract with the seller that his fees and expenses are to come out of the booking fee, but then did not collect a booking fee because of his carelessness, is he still entitled to his expenses from the sale. I ended up selling the house even though he did introduce me to the buyer initially.

Yes he is still entitled to his fees.
