Arnotts - Lost Items in Stores

Just reading a couple of messages which have been posted regarding Arnotts. I have been a regular customer of Arnotts for years and couldn't fault them on deliveries especially on furniture. Very recent, I did encounter a very shocking experience with their carpet showrooms. I purchased carpet last year and at the time, fortunate to be able pick up a end- of-roll of extremely high quality carpet which just happened to meet my measurements. I paid in full up front for the piece of carpet, underlay and fitting. As my house was being renovated at the time, they agreed to store the carpet for as long as I needed. Last week I phoned them to book in for the carpet to be delivered and fitted when I was informed that the carpet couldn't be found in the stores and it had been lost. Without going into further detail, I had many disccusions with them and expressed my disgust. I insisted that the carpet be replaced with same or same quality. I was informed by them that they would give me a full refund or I can pay the difference for the same carpet which they had sourced at nearly double the price. I feel they should be responsible in replacing with same at no additional cost.
Need advise badly on this one as I feel I am banging my head against a brick wall.
 
I'd have thought that as you have a recipt for a quantity of carpet and as they have the quantity of carpet (the resourced one) in stock they have to deliver it to you. It's no fault of yours that they lost it or that when they resourced it they had to pay more. Can you clarify if they have the carpet still on sale in the shop (resourced or otherwise) Maybe a discussion around the possibility of a trip to the small claims court would sort this out?
 
Unfortunately when i visited the shop, I was informed that they no longer stocked that particular carpet, even though they informed me at the time of purchase that the carpet was a standard Navan carpet and would always be available. I went on the website and found the carpet on Navan carpets website and it is an ongoing product. They did source it and they proceeded to inform me that it will cost double the price to replace. This has made me furious even more.
 
I think you are on to a loser in looking for a replacement.

The three remedies for breach of a contract for sale of goods are repair, replacement, or refund. In general, the seller can choose which remedy to offer, and I see nothing in your story that lifts it out of the general rules.
 
When exactly did you buy the carpet - you say last year, that could be anything from 11 months to 23 months ago. Either way, it's a long time for any store to hold onto an item, I would have thought the most would be a couple of months (especially with clearance stock).

I'd be surprised if you were entitled to anything other than a refund for what you paid & just keep your eyes peeled for another bargain
 
Thanks for the advise, helped make my decision where to go with this. I had another meeting with the director of the carpet showrooms and he did propose a good deal on the carpet which he would have to buy in to replace mine, which I didn't opt for. I was fortunate enough to pick up another end of roll which was even nicer and a higher quality than the original and with a higher price tag (200euro more). They wavered the price difference and I was a very happy bunny. thanks again for all your help.
