Yes, so, are written contracts considered normal when engaging an estate agent to sell your home?
I am dealing with some now, who don't seem to be big on written contracts. One of them is doing up something in writing for us, but only because we requested it.. he's very informal overall. So most of the terms are only verbally agreed.
Some things that should be in the written contract..
Things like 'sole agent' and what does it mean?
For example, if my cousin rings out of the blue and wants to purchase? (I wouldn't want to pay agency fees)
If a person drives by, and sees the sign, and talks to me privately, do I have to pay? (I'd be prepared to pay, ideally a reduced amount)
If one of several siblings who own the house decide to buy out the others? (I wouldn't want to pay in full, perhaps a reduced amount, but ideally nothing)
If we refuse a bid, of the asking price?, or of below the asking price?
Also things like length of contract and how it can be ended?
If the house doesn't sell for six months?
If the estate agent doesn't pass on bids?
If he puts off customers, perhaps by lying?
If we refuse a bid of the asking price?, or just below?
Should we give our instructions in writing, and should we require this to be signed?
For example... all bids must be passed on, ,once they're above the asking price - 40% upwards
and other things perhaps.
Any help would be great... am I asking too much to have a written contract?
