dear all,
i would do with a bit of advice regarding a DPP case i won (was a witness).
The accused was found guilty and got a good fine. Now they appealed.
How does it work ? Are we going in front of a different judge and do it all over again ? Can they change what they said in the first court ? Can they bring new witnesses ?
Also , till the appeal takes place are they still considered guilty ?

Thanks

Did the DPP not win the case?

Are we going in front of a different judge and do it all over again ? Yes

Can they change what they said in the first court ? Yes

Can they bring new witnesses ? Yes

till the appeal takes place are they still considered guilty ? Joe O'Reilly? Depends what the punishment was but essentially yes.

Changing their evidence and bringing in new witnesses would obviously be challenged.

Thank you Stifster
Yes DPP won the case , the accused appealed.
Punishment was a fine + 2 years bound to piece

What type of appeal?

Is the accused appealing the guilty verdict OR the severity of the punishment?

i don't know to be honest. being a witness i am not made aware of anything really.

I thought that appeals could only be based on a point of law, not on new evidence or changed stories.

if you can establish if he is appealing the sentence or conviction or both it could help. he signs an appeal form on which he states what he is appealing. if he is appealing sentence and conviction you must go through the whol;e process again. if he is appealing the sentence only, the facts will be given by the garda and you will not be required.
