Hi All,

apologies for this it has probably been asked before but I couldn't find the thread for it.
my brother has recently come home and has an apartment in Sydney which he has no plans to sell.
he wants to buy here will he have to pay stamp duty?

As he is no longer a first time buyer (FTB), there is a strong chance that he WILL have to pay stamp duty (buying a property anywhere in the world means you cannot be a FTB in Ireland).

But stamp duty payable will depend on

(a) value of the property
(b) new or secondhand

now wanting to avoid paying any tax but how will the revenue know he owns an apartment in sydney...

It's self assesment. He can lie when when he's purchasing the Irish property but then he'd be defrauding the state and would be open to prosecution. If he needs the cash so badly he should just get a gun and hold up old ladies in the street, it'd be much more effecient.

seriously though I thought he would have to pay stamp duty but he thinks that since he had to pay all the taxes associated with buying a place in Sydney that he actually didn't receive any allowances for buying his first home. I have to say I am inclined to agree with him. He got no benefit from being a first time buyer in Australia from Ireland. Probably opening up another can of worms in this thread but he is back in Ireland now and is paying a high rate of tax as he earns a good salary. And he will be landed with another tax for buying a place here. I know if he buys a new house he wouldn't have to pay any stamp duty but he wants to build his own house so he will be liable for stamp duty.

Why on earth should he have received allowances from Ireland for buying in Australia!?
Probably opening up another can of worms in this thread but he is back in Ireland now and is paying a high rate of tax as he earns a good salary.
Check out the figures and compare to other countries - Ireland is no longer a high income tax economy.
 
Personally, I think it should be if you've bought anywhere in Europe, especially in those countries where we have taxation agreements.
 
I agree with you that there should be some sort of tax agreements between countries. I wasn't saying that he should of got any allowances from the irish governement when the apartment was in Sydney I was just saying he has already paid stamp duty in Oz so he didn't get any allowance for buying his first place like I did with mine. And he wouldn't get any allowances for buying here either.
