I purchased sandals for my children from a well known orthopaedic sandal shop in a Med country, which resulted in blisters, bad blisters for the children. The shoes were fitted by the shop. I have spoken, at the suggestion of the shop, to the manufacturer who says that my contract is with the agent - which I assumed. The shop eventually said that they would exchange like for like which doesn't solve the blistering problem nor the refusal of the children to wear these shoes again given that they were in pain for almost 2 weeks after wearing them.
As a refund or credit note is out as per shop policy, I said as a concession that I would exchange for the adult version - this is not an option for the shop they say they can't do this as they have been told by the manufacturer that they can only exchange like for like. The manufacturer says the decision is not theirs, they only advise, it rests with agent/shop.
The shop have told me that the manufacturer laughed when they heard that my children were blistered from wearing their shoes,which maufacturer denies, and when I said I was not leaving until it was resolved the attitude was well lock her in, kids are with me by the way, we are in the Med and it is 30+ outside and the shop closes at lunchtime. Needless to say I didn't exactly keep my cool, but neither did I lose the plot completely.
Am I covered under EU consumer protection that these othopaedic sandals are not fit for purpose as they have temporarily damaged my childrens feet. I only want my money back or an exchange.
I have been to the shop 4 or 5 times to sort this out, I called the sales manager several times and finally spoke to her 2 weeks ago - today was the first day she was available to meet me.
Any suggestions what I do next.
Edited to add they have worn this brand of sandal before without issue.
