Does anyone known a good contact who knows something about the 2004 legislation that changed all these pension arrangements for civil servants.
I tried my local solicitor but he couldn’t recommend anybody.

I'm working in the HSE and my local personnel office say I'm a new entrant.

I was made permanent in Aug 2004, but worked for the HSE from Jan 2000 to May 2003 and then rejoined the HSE in Aug 2004 doing the same job.

The legislation says that if you had the same contract previous to 2004 then you are not deemed a new entrant.

And the joke is the HSE forced me to pay for pension arrears for the period Jan 2000 to May 2003 when I was made permanent in 2004!

Please help!!!

You have no choice in repaying for your temp service and its a good thing as in the past poeple forgot to buy it back and got shafted with compound interest when they remembered to buy it.

As far as i am aware if you broke your service as many have done then the new rules apply but im not certain.

If you have the legislation that states different then copy it and email it to personell dept asking them to confirm that it applies to you.

dont think you need a lawyer if this is the case.

Yes I intend to pursue it with my union. Have said this to my local personnel office but they don't want to hear about it....as far as they are concerned I started after 1st April 2004 and that's that...it's all about personalities in the HSE if you didn’t know already. I was temporary from Jan 2000 to May 2003, permanent now. But here’s the legislation I’m talking about in the 2004 Act

4) Where—
………
(b) a person was serving in a public service body or a body to which Schedule 1 relates prior to 31 March 2004 and left such an office or position and takes up appointment as a public servant on or after 1 April 2004—

(i) under the same contract of employment,

then, such person shall not be regarded as a new entrant and the provisions applicable to a public servant shall, but only in so far as the application of provisions relating to retirement age and superannuation, as the case may be, apply in the same manner as to a person serving in the public service on 31 March 2004.

What is the implication of being a new entrant? No matter what-you have to pay pension contributions for your temporary service and the sooner the better or it will cost you dear.

You say it's all about personalities in the HSE! What do you mean? Usually, the people in HR apply the law and regs. without fear or favour - or do you know otherwise?
