Age limit on Inheritance

Hi There,
My brother in law is going to inherit the family farm when the time arrives (One parent still alive). I seem to remember reading an article somewhere that if he inherited the property before the age of 33, his tax implications would be lower. Now I am not suggesting he bumbs off his mam, but is there any truth in this. Could he inherit the property now or get it as a gift.

90% relief is available on CAT on agricultural property if you are a
farmer and meet the requirements. Its not age related and applies to either gifts or inheritances.

Thanks for the reply capall. I there anywhere you know I could look for further info.

On the revenue site under leaflets and guides this have a leaflet CAT5 on ag relief.
The main requirement is that after the gift/inheritance 80% of the gross value of your assets is comprised of
agricultural property

transfer of farm

The age you are thinking of is probably 35. If your brother is a "young trained farmer" - i.e. under the age of 35 and holder of a "green cert" or equivalent qualification, he gets a stamp duty exemption. With stamp duty on a transfer of farmland being 4.5% between blood relatives, this is a significant relief.

As other have already pointed out, there are no inheritance tax consequences either way.
