I just heard the end of an interview on Matt Cooper and I think he said it was Brendan Burgess was one of the contributors. I would like to repeat his advice that anyone with such problems should at all times lodge something each month. Simple but excellent advice which will stand to the borrower if he/she find themselves in Court as Brendan said.

I saw it reported elsewhere that one of the things Brendan said was:

if you explain to the Judge that you were doing your best then he won't grant the repossession order.

While it is important to encourage people to be open and proactive in their dealings with banks and the courts, I'm not sure that type of advice puts people in the right frame of mind.

Best simply to realise that you could lose you home and be left with residual debt besides, so take it very seriously and speak with your lender early and often. And if you find youself summoned to court, make sure you attend and communicate your efforts and willingness to cooperate.

if you find yourself in front of a judge facing a repossession then it has gone way too far between you and the lender, if you make an attempt to service your debts this will likely not happen, so at the first sign of a problem make sure you get into negotiations or some kind of payment plan, a problem addressed early and sensibly is likely to end with a better outcome.
