Advice on paying non-refundable deposits for private schools

Hi,
Im not sure whether this is the correct forum. We paid a booking deposit for our daughter in a local school of 150 euros. They say on the form that when they offer a place that we then need to send a fee of one months fees in advance, non refundable but will be taken off the years fees (450 euros).
On the wednesday we handed in a cheque for 450 euros and on the thursday evening we got a call to say that she had been accepted in the school that we really wanted. I chequed our account and the 450 cheque hadnt been presented to the bank. So I rang the school first thing on friday to tell them that he had got a space elsewhere (they knew he was on the waiting list).

We then wrote and asked them to send us back the cheque and we cancelled it. We have since received a a letter stating that it is on their terms and conditions on the booking form and the letter and that we need to pay 450.

However, we feel that yes, if they had cashed the cheque, we would have accepted that it was non refundable but the fact that it hadn't been cashed meant that we were within our rights to cancel it. Having already paid 150.

What does anyone else think? We feel that we are within our rights but neither do we want to do something that is dishonest.
Opinions would be great please!

€450 a year seems very cheap for a fee-paying school!

I would suggest it's most unlikely they will follow up on the debt other than firing off another couple of letters.

Whether or not you pay it is up to you; if there's a waiting list then it's most likely that they have another pupil to take your place.
 
Maybe they have misunderstood and still think that you want her place reserved. If not and they are simply insisting on payment then if it was me I would be inclined to just let them sing for it. I doubt that there would be any repercussions from this and can't see that any reasonable person would assume that they have a right to the €450.
 

I agree - I know that many schools do this to try and stop people from accepting places and then cancelling when getting a place somewhere else but in this instance the school was too slow in lodging the cheque and the OP is within his rights to cancel a payment and (in my opinion) morally right to do this as well.

In practical terms I don't think the school will waste the effort on chasing up on the €450 so I wouldn't loose any sleep over it.
 
€450 p.m. = €5,400 p.a. = €104 p.w. is a lot less than creche fees for a pre schooler in many cases!

don't say that I was thinking it sounded dear - can you tell I haven't looked into creches yet? Maybe I should just get pregnant again and delay having to pay that much!
