Hi

Ive a couple of questions on adding a codicil to amend a will.

1) does the two witnesses have to be the same as the original witnesses of the will - one is away at the minute so I might need a new witness.

2)Can the witnesses to the codicil be beneficiaries under the main will but not under the codicil.

3) Is it better to type it up or handwritten?

4) would text such as;

I xxxx of xxx address on xxx date wish to add this codicil to amend my will. To my xxx I leave xxxx to y I l leave. this is the only change to my original will.

Would it be as easy to redo the will from scratch? If you are a credit union member, most CU's have a deal with a local solicitor to do a will for free.

2. I'm not certain, but I've a strong feeling the answer is no.
3. Makes no odds, but if you have access to a computer and printer, it can't hurt to type it for the sake of legibility.
4. It sounds a bit weak to me - it leaves open a question as to what is your original will, ad doesn't deal with testamentary capacity. It would probably be okay, but I'd want better than probably when dealing with my will. To ensure you get it right, I'd consult a solicitor. A codicil going wrong could lead to a lot of hassle later. You might be consider drafting the entire will again, revoking the current one, of course. You can just copy the construction of the original will.

Thanks for the replies - your right I will redo the will from scratch just in case. a sudden death in the family has made us all rethink our affairs this week, the clearer and simpler the better I think.
