The parents of my ex-partner is throwing her and my to 2 children out of their house,I have not been with her for several year but take the children 2-3 days a week.Does anyone know if i can offer them a room or two in my house or how would it affect her child benifits.

Re: Accommodation/child benifit

Child benefit is not affected by accomodation issues and is not measn-tested. Is she is receipt of One-parent Family Payment? If so, she will have to notify SW of her change of residence, but there will be no problem with her continuing to recieve it as, presumably, she is not co-habiting with you, but nrather jsut a tenant in your house.

Re: Accommodation/child benifit

thanks for the reply Welfarite, sorry i not much in the know of her entitlement, she is claiming one-parent benifit while living at home with her parents, but her father is retiring soon and wants her out. i would not have the children go without for a minute but i can't afford to take in herself and loose the rent on the room and pay a large morgage and she could'nt live on the monthly payment only.Is their anyway i can help her.

yes.but its was always a agreement between us,im not sure if i should have made it official,I am only claiming one parent benifit for one child for 2 days a week.

I'd imagine that you might both lose out on payments in those circumstances, I'm not sure that the Welfare would be prepared to accept that there was a difference between co-habiting and renting a room in the same house (I'm not implying that you are not genuine but there would be a lot of scope for abusing the system)

There's more to co-habiting that renting a room and I don't think that fact alone would cause benefit to cease. The definition for co-habitation for SW purposes takes into account socialising together, sharing bills, travelling together, etc as well as the obvious sexual relationship factor.

I'm confused. Are you saying that you are getting One-Parent Family Payment as well as the mother?!?!? This is not possible under SW rules! And not for 2 days a week either!

I know its sounds like one of these cases but unfortunely it is real, her parents won't help here regarding letters so she can rent elsewhere and nor can she afford with the price local to ourselves so the kids can stay in the same school so the only way is to move onto the street and look for emergency housing but noboby could allow the children to do that (except hers).Doing everything above board is there any way forward without all of us being on the street in six months.
