3 R's replacing Phone with Three

Bought a phone Nokia 6500 slide back in Jan of this year from 3

In October the scrolling broke on it and it was sent of to repair

Got it back a week later and still broken

Sent it of again

They replaced it with the same phone

Then problem with the memory card it was not retaining the information

Sent it of for repair and got it back and not working still

I rang up and they can only offer me a Nokia 6288 which I do not want and its a lower brand make than

I have done 2 of the 3 R (repair & replace)

I then requested a refund

They told me that they cannot do this through their customer service in Mumbai
and were adament in this

Gave me the address of a po box in Dublin 2 to write to

Other then taking to the small claims court what are my options ?
 
Letter before action to their D2 registered office giving them 7 days to refund, this will be sent to Mumbai for their attention. There is no CS located in Ireland.

If the response is unsatisfactory then the small claims court is the way to go.
 
Sent a letter to the customer service via email also faxed this and will be posting letter to their PO Box number in dublin 2

They are standing firm on not giving me refund and have offered me a lower value phone

Also going out to the store that I was dealing with and also going to give them a copy of the letter. Will stay in shop until I get an answer

They were dealing directly with customer service in the UK

Standing firm on this and also checked with consumer affairs and quoted 3 about the Sale of goods act but still no movement on them. The sales reps in their store speaking to some of them on the phone say I should get a refund but their hands are tied

Seriously thinking about the small claims court as they are just no trying to fob me of
 
Under Law isnt the shop, not the supplier, responsible for refunds? So surely you can ask for a refund at the place you purchased the phone and if they go on about Mumbai or whatever else, tell them thats their problem, not yours.
 
I take it you never tried to get a refund/service from Currys/Dixons/PC World then?
Company policy is exactly that they will never budge.
 
Went back in their shop asked again for a refund and was told that their company policy was not to issue refunds after the 14 day after purchase. I did say that it was still under warrenty. Again offered me lower brand. Was willing to accept the depreciation on the phone after 9 months but they said no.Asked them for their written refund policies and they could not give it to me ?

Went onto the consumer agency website and lodged a complaint with them

Still waiting to here back from 3 and a response to my letter of complaint
 
You will be waiting, you will be lucky if 3 mumbai call you.
They did and all they told me was to restore it to factory settings. Did this and it worked for about a minute
Told them to contact the consumer affairs to check my rights but all their doing is following procedures and I am getting nowhere with them re a refund thus going to keep on ringing and calling into swords branch until I get a satisfactory result
 
Rang again now offering another exchange for Nokia 6220 but I want a refund not an exchange

NCA advised me that I should let the store were I bought it know, Grafton Street, I have been dealing with their Swords branch so will post my letter to them also just to let them know

Looking at the small claims as getting nowhere fast with them and their customer service is just a small bit behind that of Ryanair not much but
 
Taking them to the small claims court you can now do this online for €15

Letter issued by them to 3 had no reply from them up to now

Was told by small claims court not to get in touch with them

They have 6 weeks to respond, so thats early Jan

Worse customer service ever :mad:
 
Hopefully you will get a result now. It took me about 3 months to see anything from the court action.
 
Go with court action, once they see the letter they will do everything to make it go away.
I worked for them for only 3 months and had to report them to the labour relations commission for unpaid wages- it took ages (over 6 months) and they dragged their heels the whole way, but I got my money. They are the most incompetent company I've ever come across, and they know little of retail policy and consumer law.
But once you know that you're right, the victory will be worth it in the end. It is a painful process, but if you aren't willing to settle for anything less than your entitlements, then stick with it.
 
Well the small claims court called me today and 3 will fully refund me

Went up to store, had to bring original box,just have to give them the memory card and earphones

Then a cheque will be issued to me for the full amount I paid for and sent to the small claims court and they will send it to me

New phone with a different operator but I was disappointed that I had to go to this length to get this.Had credit on the 3 handset but I just wanted to get away from them
